Notice Period Dilemma: Can I Claim Pay for Days Not Served if Company Wants Early Exit?

ankittpl
I am working in a company and have resigned from my job. I am supposed to serve a notice period of 30 days, and I am ready to serve the entire notice period. However, the company is asking me for early relief and they don't want to pay for the remaining days. I am asking them for the money for the remaining days, but they don't want me to serve. As per my appointment letter, clause no. 9 states: "After confirmation, either party can terminate this contract of employment by giving one month's notice or on payment of one month's salary in lieu of one month's notice to the other party."

Questions Regarding Notice Period and Compensation

I have the following questions:
1. Is what they are doing correct or not?
2. Am I eligible for the money for the remaining days I am not serving?

Thank you.

Dear Ankit,

Since they are releasing you, yes, they must pay you. But then you might need to wrestle it out with them because they are unwilling. How big is the amount? Is it worth putting up the fight? Request you to focus on a positive reference check. Please make sure that happens.

Wish you all the best!

You have resigned and given notice of one month, but your employer is relieving you early without payment for the remaining days of the notice. In this case, he is not doing anything wrong because you have given notice, but the other party does not want you to complete your notice. This is sometimes done for administrative purposes.

On the contrary, if the employer has given you notice and relieved you early without payment for the remaining days, then there was a mistake, and you should have been paid.

Note: Please excuse me, Ms. (Cite Contribution), for my different views.

Thanks
