Gratuity - Gratuity Letter [Thread 560444]

Vanakkam!Iam Radhika and I am 59years old and worked in a private school for the past 25 years and officially retired last June2015 and worked for one more year till April 23rd.2016,which was the last working day for teachers.when I submitted a letter claiming my gratuity they denied it saying the school doesn't have enough money.It is such a big school making profits in crore.And even though I worked till the last working day they didn't pay my full salary for the month ofApril.Advise me in this matter. How to claim my gratuity?

Put up a written request to the chairman of the school.
Enclose application for gratuity in the laid down form as Per gratuity Act/rules.
Follow it up with a reminder.
All by registered post so that there is proof of delivery.
Give details of your service-date of joining,retirement and number of years of service and ask for gratuity.
If you do not get a reply,then write to District Education officer with full details and main copy of application to Labour Officer of the area.
Give formal complaint about denial of gratuity.
I am sure the school will pay gratuity as they are legally bound to pay gratuity.

Hello Radhika,
Please follow the steps narrated by Nathrao. As per the Payment of Gratuity act, an organization is supposed to settle the gratuity on the last working day itself (citation required). Else you are vested with rights to approach the labour department and you can file a case under Payment of gratuity Act. They will call the management for hearing and will get the dispute solved.
