Understanding L1 Visa: Salary, L2 Visa Requirements, and Tax Implications?

Hi,

Can anyone shed some light on L1 visa rules?

1. Is it mandatory to provide an L2 visa along with the L1 visa?
2. Should a person who is granted an L1 visa receive an Indian salary or a salary from the USA?
3. If our USA company has to provide the salary, what taxes does the employee have to pay?

Please find below my answers:

1. Is it mandatory to provide an L2 visa along with an L1 visa?
Spouse Passport / Marriage Certificate / A request letter from the company stating that she/he requires L2.

2. Should a person to whom we are giving an L1 visa receive an Indian salary or a salary from the USA?
You can pay an Indian salary. Please ensure you pay the US minimum salary of $23,670 per annum. You can deduct his CTC/TR from $23,670 and pay the balance as per diem.

3. If our USA company has to provide a salary, what taxes does an employee have to pay?
Yes.

Thank you for the prompt response. I have some additional questions that require clarification.

I would like to know how much tax would be deducted from his salary if we pay him in the US. Would it be the same as for an employee on an H1B visa receiving only US salary? Is it obligatory to pay him a salary in both India and the US?

L2 is needed when your spouse and/or dependents want to accompany you. You can pay the salary in Indian Rupees.
