Can My Employer Demand an Ultrasound for Maternity Benefits? Understanding Your Rights

Mr.Bean
I submitted a pregnancy test report as proof of pregnancy, but the company doctor is insisting on an ultrasound scan report to confirm the pregnancy. The company's maternity policy mentions only the test report but is not specific to a particular test report. I am not happy about submitting the ultrasound report and want to understand if the employer can ask for it to avail maternity benefits. Are maternity benefits not protected by law? Both HR and the company doctor are insisting on submitting the ultrasound report, and I am not pleased with this. Please help me understand the employee rights in this regard.

Maternity Benefits and Legal Requirements

Notice of pregnancy from your doctor is sufficient. The requirement for an ultrasound scan (USG) is excessive. Maternity benefits are protected by law and cannot be legally withheld. The production of a certificate in Form 2 from a registered medical practitioner certifying the pregnancy, delivery, miscarriage, or illness arising out of pregnancy, delivery, premature birth of a child, or miscarriage of a woman shall, for the purpose of the Act and these rules, be proof of such pregnancy, delivery, miscarriage, or, as the case may be. Please produce a medical certificate from your doctor, and that is adequate.

As I know, it is Form B under the Maternity Benefit Act for the Certificate from a Certified Medical Practitioner.

Decline to submit USG as it is too personal a report. Quote the relevant sections of MB act and politely inform them not to ask for what is laid down in the Act.

You are only supposed to give Form B under the Maternity Benefit Act, and it is to be authorized by a certified medical practitioner.

1. Why are you even supposed to submit a proof?

2. Does your company's HR policy or HR manual state that you have to submit the proof?

3. If it says so, can you get your hands on that?

4. It's illegal to ask for any proof whatsoever as per the Indian Constitution.

5. You can drag your organization for harassing you.
Mr.Bean
Company in their Maternity Policy has mentioned "test report" to be submitted to confirm the pregnancy by the company doctor. I submitted a pregnancy test report from diagnostics, and now they are asking for a USG to be submitted to confirm. I'm not sure why they are insisting on a particular test report; everyone is blindly following whatever HR is asking...

Company is exceeding the legal requirement by being intrusive in the name of verification. A complaint to the local labor officer will bring them to follow normal procedure as per the law laid down.
Mr.Bean
Thank you for all the inputs; they have been very helpful, and I understand the requirements. I will definitely decline to submit a report. I would appreciate assistance in drafting a letter to the HR team. If anyone can PM me or reply to this message with a sample draft email, it would be greatly appreciated.
