Facing Leave and Transfer Issues at Work: Should My Wife Resign Without Serving Notice?

My wife works with a bank, and the following issues have been pending for the last three months:

1. Leave Allocation Problem
There is a problem with leave allocation in the system for her. No leaves are allocated due to a system problem, and hence, her salary is deducted. This issue has not been resolved for the last eight months.

2. Leave Approval Issues
Her boss is not approving leaves after her request for transfer (from one city to another due to marriage). Birthday leaves are to be mandatorily approved as per company policy, but those too are not approved. He keeps the leave approval pending or rejects them every time, even when asked in advance.

3. Transfer Request Delays
A transfer request was made in January, but there is still no written communication from HR regarding the update, just verbal communication that they are working on it. Now, she plans to resign and does not intend to serve the notice period, which is three months.

Please guide on the possible ways to move forward.

Considerations Before Resigning Without Notice

Resigning without a notice period will only create a situation where the Full and Final (FNF) settlement will be further delayed. Relieving documents will not be forthcoming. If you are planning to work again, these issues will be problematic.

Instead, first approach the higher management of the bank with proof of these issues in writing. Refer to the bank's policy in your communications.

Is your wife the only one facing problems with leave and salary deductions due to a system problem? What about other employees facing similar issues? Speak to them as well and ask how they are handling the situation. Do not make a hasty decision to resign. No one will take over her duties, which can cause problems. I presume the duties are financial in nature, and simply leaving them is dangerous.

System Issues and Leave Allocation

The system is handled by a third party, and after the appraisal last year, she has been raising issues. Every month, two holidays were added to her account. However, for the last three months, this has stopped. She has been escalating at the regional level, but there has been no help, just a reply stating that they are working on it. Reporting at a higher level may create problems.

Leave Approval Problems

Secondly, the boss is not approving her leave, including the birthday leave, which is her right as per the policy. The first HR mentioned that the transfer would be done by the first week of April. Since then, there have been three HR changes. If she had known about this earlier, she would have resigned at that time.

Personal Considerations and Alternatives

We got married recently in December, and it doesn't make sense to live separately in two different cities. Is there another way out, such as medical leave or conditions under which she can be immediately relieved?

Like Nathrao mentioned, suggest asking your wife to check with other employees if they are having similar problems with leave allocation. Please note that if this is a system error or problem, computers don't discriminate. Everyone ought to be facing the same problem. If it's only your wife who is facing this issue and being told that it's a computer problem, you can be sure she's being fed some "crap."

This was a routine response years ago when computerization wasn't very common. No one understood the limitations of systems and processes being computerized and just believed when given this ruse.

But going by what you have mentioned, it is very likely that the actual reasons are different, and her not being granted any leaves is just a manifestation of those reasons. I think there's more that could have happened in the background—some of which may not have been in your wife's control and some which may have been. You need to delve further into her working career in this bank to ascertain before you can even think of possible solutions or actions.

You haven't mentioned since when she has been working in this bank. Presuming she was working here even before your marriage, was there any issue or problem while granting her marriage leave or other leaves earlier?

Regarding resigning, it's your wife's prerogative. But I suggest she desist from leaving in a huff without serving the notice period. Such steps have high chances of coming back later to adversely affect her career. Let her serve the notice period, collect the relieving documents, and only then move on.

Please let me know if she is an officer or a clerk at a private bank or a nationalized bank. System updates regarding leave have nothing to do with a transfer request. Leave records will be updated subsequent to the transfer. The system will not deduct salary unless advised by the branch to the Salary section. Furthermore, leave can be granted manually as a manual leave record is required to be maintained since the system is not yet perfected. Please take up the matter with the Union/Association.

Regarding transfers, please follow up at the Head Office (HO) and seek the assistance of the Association/Union.
