Employee Left a Month Ago, Now Injured: Can They Still Claim ESI Benefits?

Can anyone guide, one of my employees has left the organization one month before, but he has faced an accident. Can he claim ESI benefits?

Sir, the employee who left the employment can avail medical facilities only if he was eligible and until his eligibility in the relevant benefit period. The said former employee can discuss the issue with the Branch Office of ESIC to which he was attached.

If his ESIC account is still valid, he can claim the benefits. As Harsh said, the benefits continue till the end of the 6-month block (June and Dec, I think). The fact that he does not work with you anymore makes little difference. The only problem I think is that ESIC covers accidents in the course of employment. How will he fit the claim within those parameters?

It depends on his date of joining in ESIC. If the employee is in the contribution period, he may be entitled to a claim.

Hi,

The employee is eligible for treatment. As you are asking now, probably he met with the accident in April or March. As you said he worked until the previous month, then that should be February. He is eligible for treatment until December 2016, provided he contributed to ESI for at least 68 days during October 2015 to February 2016. The reimbursement part may be difficult, but for treatment, I am sure that he can avail.
