Is ESI Coverage Limited to Certain Areas in Tripura? Seeking Clarity on Regional Applicability

Dear All,

Our company has a registered office in Kolkata but works mainly in Tripura. I wanted to know if ESI is applicable in the entire Tripura or just in a few parts of Tripura, and from when it's applicable. Can you please help me out regarding regions where it's not applicable in Tripura?

Further, in case it's only applicable in Agartala, if a person residing in Agartala is working at my project in Kamalpur (another place in Tripura), then whether ESI will be applicable for him.

Coverage Under the ESI Act, 1948

1. The coverage of an employee under the ESI Act, 1948 is based on the location of the unit, establishment, or factory. Only if the area has been implemented under section 1(3) of the Act will the units situated in that area be covered. The residence of the employee is not a factor.

Implementation in Tripura

2. Confirmation of which areas in Tripura are currently declared as implemented is challenging. ESIC recently announced plans to implement the Act in more North-Eastern States. The actual position of implementation or extension of the scheme in Tripura may be better known at the Regional Office of ESIC in Kolkata (West Bengal) or the Regional Office in Assam, Guwahati. You may confirm the position with the concerned officers in these regions. Their emails and contact numbers can be found on the ESIC Headquarters website.

ESI Act Coverage and Implementation

Once your company is covered under the ESI Act, it will be applicable to your employees unless they are in an exempted area. The residence of the employees is not vital in relation to the coverage of the ESI Act.
