Overtime Work and Employment Regulations
Overtime work is an aspect of employment that arises from exigencies. Therefore, when asked by the employer to work beyond the normal working hours, it is the duty of the employee to comply. However, such an arrangement is restricted by the factors of time and compensation. The total number of working hours per day and per week shall not exceed the maximum number of hours of work, including overtime, prescribed under the applicable establishment-related Act.
I think the questioner works in an IT or ITES establishment. If correct, the State's Shops and Establishments Act is applicable to his establishment. The maximum hours of work, including overtime, is 10 hours per day and 48 hours per week. Therefore, if asked daily to work 2 extra hours, the total number of working hours, including overtime, would be [(8x6) + (2x6)] 60, against the maximum of 54 fixed under the Act.
