High Court Halts Bonus Act Amendments: What This Means for Employers in Karnataka

Dr Gubbi & Associates
As you are aware, FKCCI, Private Hospitals and Nursing Homes Association of Karnataka, and Bangalore Employers Association had moved the High Court of Karnataka by way of a Writ Petition to bring a stay on the amendments made to the Payment of Bonus Act. We are glad to inform our clients that the High Court, by its interim order dated 28th March 2016, has granted an interim stay on the entire amendment which has been challenged by us. It means that all amendments, including its retrospective effect, have been stayed. Dr. Gubbi & Santhosh Narayan, Counselors & Advocates, were instrumental in bringing the stay order.

Such of the members/clients who were not a party to the Writ Petition and who wish to be a party may contact Dr. Gubbi on or before 30th April 2016, by email at [Email Removed For Privacy Reasons]. The professional fee for impleading each party is Rs. 5000.

Thank you for the valuable post. Please find attached two circulars from the M.P. Labour Department regarding Bonus Amendments. Could you please clarify the status of the attached circulars on the aforementioned matters? I would be extremely grateful for your assistance.
