Can I Opt Out of ESIC to Use My Husband's Medical Benefits Instead?

Hi, I am working in a reputed company, and my ESIC is being deducted. My husband works in a public sector company where he receives medical benefits. Since I am also covered under his medical plan, I would like to withdraw from ESIC to take advantage of the benefits provided by his company. Can you please assist me with this?

ESI is mandatory. You have to remain compulsorily covered even if you are covered by other/better insurance and medical facilities.

The coverage and benefits under the ESI Act, 1948 are applicable because you are working in a unit where the said Act is enforced. There is no exemption based on the fact that the spouse of an insured person is receiving medical benefits due to being employed in a PSU. However, it is important to note that the benefits provided under the aforementioned Act are more comprehensive and extensive compared to what may be available to the family members of an employee in a PSU.
