Can a Company Deny PF Withdrawal After Termination for Reporting Unethical Practices?

Hi, one of my friends has been terminated from the job after working for almost 6.5 years as he found some unethical work being done on the official database. As a result, he did not receive his salary and gratuity (which is mentioned in his appointment letter). Now, he wants to apply for PF and has approached the company. They said that as a terminated employee, he is not eligible to withdraw the PF. Can the employer stop this?

Hi Disa,

You can't stop the PF of the said employee. In that case, you may not proceed with his PF form manually or online; he may directly approach the PF office and submit the form. The PF office will then ask you for declaration and authorization.
