Facing a Salary Cut and Unpaid Wages: What Steps Should I Take Against My Company?

I joined xxxxj Finance in January 2016 as a Sales Executive in the APR Department (dealing only with the sale of Apple iPhones) on third-party payroll through Addeco India. Upon joining, I was provided with an offer letter stating a gross salary of 18k and a net in-hand amount of 16,740. However, after one month, my Sales Manager informed me that Apple had terminated its partnership with Bajaj Finance, leaving me with no choice but to be moved to a different department where my net in-hand salary would be only 8,700 INR.

As of March 13, 2016, I have not received my salaries for January and February. I am considering filing a case against the company for issuing me an offer letter with a salary of 18k but subsequently reducing it without any prior legal notice, such as an email or hard copy.

Please advise me on the appropriate course of action in this situation.

I understand your problem with the company not keeping its word and behaving arbitrarily. During the period you have been working, I am sure you could have determined whether the agreement for the sale of the iPhone has indeed been canceled. What I would do is talk to management about your pay, which has not been received for the last two months. Put your points in writing so that there is documentation regarding the non-payment, etc.

Are you the only person affected, or are there others as well? Are you in a financial position to engage in a legal battle? Consult a lawyer for advice and a way forward. Before taking legal action, consider discussing the matter with your HR department and try to involve other affected employees. You may also consider contacting local labor officials.
