Am I Eligible for Gratuity Based on My Notice Period? Seeking Clarity on Service Years

I joined the company on 19th August 2007 and left on 28th January 2016, completing 8 years, 5 months, and 9 days. I paid the notice period until 8th March 2016. Am I eligible for gratuity based on 9 years or 8 years of service? In other words, is the notice period paid considered for gratuity calculation?

Hi Buddy,

The buyout period should not be considered as continuous service according to the Gratuity Act of 1972; hence, you should receive gratuity for 8 years.
