Am I Eligible for Gratuity After 4 Years and 252 Days of Service Without LOP?

MATHEWSMBA
I worked in a private firm. My joining date was 19 May 2011, and my resignation date is 03 Feb 2016 (working for 4 years and 252 days). There were no instances of leave without pay (LOP) in my company records. I received my salary for all 4 years and 252 days in my account. Am I eligible for gratuity? Please help me.

Dear M/S,

As per the Gratuity Act of 1972, you need to work continuously in a company for 5 years or 4 years and 240 days. The following are the conditions:

1. In each year, there should be 240 paid days (which includes leaves with wages).
2. If you have worked less than 240 days in any year, that year will not be considered.
3. Calculation: For every year, 15 days of salary will be given.
Formula: Last drawn basic + D.A / 26 days per month X 15 days per year X Number of years worked.

Thanks and Regards,
Aditya.
