Can My Former Employer Demand Payment After I Left and Served Notice? Seeking Advice on Legal Actions

Hi,

I left my previous organization, CSC, after serving the notice period. I joined as a fresher and signed the service agreement. However, I left before completing the two-year service agreement. I received the FNF (Full and Final) letter asking me to pay 1 lakh. I am not willing to pay such a huge amount after working for 15 months and serving the notice period as well. I want to know if they can take any action. Can they abscond me to prevent me from applying to any other company?

What was the agreement regarding breach of the service agreement? Has the company formally accepted your resignation? Put the relevant clauses of the service agreement on the forum (mask your details, etc.) so that members can advise properly. Prima facie, the demand for 1 lakh appears to be on the higher side.

Hi, in response to your feedback—The agreement was for the new hires (freshers). Since I joined here as a fresher, I had to sign the service agreement. The agreement holds for 24 months post joining. Since I quit CSC after 15 months of joining, I had to pay a service agreement amount (1 lakh), but covering 15 months in CSC and even the notice period did not reduce my recovery amount. I am not willing to pay such a huge amount, but CSC won't grant me my experience letter and relieving letter if I do not pay the recovery amount.

Did the company provide any special training for you?

The problem that may arise is the company could delay your documents and cause you trouble. It's recommended to communicate with them and attempt to resolve the issue. Pursuing a legal course of action can be time-consuming, even if you are entirely in the right. Remember, bonds should not be utilized to restrict job mobility.

Yes, the company provided a 30-day training program. I am unsure about what to discuss regarding this matter as they simply mentioned that, according to the agreement, I am required to pay 1 lakh.

Did the agreement speak of Rs1 lakh as charges for breach of agreement?

Please let me know what happened to your agreement problem with CSC. I came across the same issue. Have you paid the amount? How have you handled the problem?

I joined CSC two weeks ago as an experienced professional with 2 years of experience. I have not been assigned to any account, so no training or investment has been made by CSC on me. Now, I need to exit from CSC.

Kindly suggest to me how to proceed.
