What Gratuity Act For Merging/Acquisition Of Two Companies.

Can I get the Gratuity amount from my previous company which got merged/acquired by my existing company and in my Prev company I 've not completed 5 yrs yet. What is the law of gratuity for this kind of situation.
If not as per the calculation of gratuity that is only applicable in case of completion of 5 yrs then Can I get the monthly gratuity deducted amount from my prev emloyer or can this gratuity be transfered to the new company.
Gratuity is a part of CTC in my previous company. Pleae suggest.

Dear Seema
It is depend upon the agreement made between the both company. If in agreement, it is mentioned that all liability of previous employer will be taken carte by the new company than it is possible that u will be eligible for your gratuity. Pl confirm by the your current employer.
if your gratuity is a part of your CTC than in this case Some company pay the gratuity amount as per prorata basis.
Pl get confirm from your present employer what is the clause of agreement regarding the employees benefit.
