Am I Eligible for Gratuity After 4 Years and 9 Months of Service? Seeking Advice from Seniors

Dear Seniors,

I need your valuable suggestions regarding gratuity as I have not completed 5 years in my current organization. My date of joining was 28th May 2011, and I recently submitted my resignation on 14th Jan 2016 with a 2-month notice period, making my last working day 13th March 2016.

Am I eligible for gratuity even though I will be completing 4 years, 9 months, and 15 days instead of the full 5 years?

Dear Omkar,

If an employee has continuous service with a single company for 4 years and 240 days, then he/she is eligible to get Gratuity. As you said you are going to complete 4 years 9 months and 15 days on 13th March 2016, it means you are eligible to get gratuity.

Dear Omkar,

As per the Payment of Gratuity Act 1972, an employee who has completed 4 years (240 days) of continuous service is eligible to receive gratuity.

Hi Omkar, you are eligible for gratuity if you have completed 4 years and 240 days. This is not written in the act, but it has been decided by the courts.
