Navigating Overlapping Job Dates: Can I Legally Start a New Job While on Leave?

Hi All, I am in a difficult situation. My current employer, X, is based in Delhi with shift timings from 6:30 am to 3 pm. On the other hand, my future employer, Y, is based in Pune with shift timings from 2 pm to 11 pm. My current company has a mandatory notice period of 3 months, and my last working day is scheduled for 22nd Feb (Monday), coinciding with my new joining date at Y. I have attempted to negotiate my last working day at X to be on 19th Feb (Friday) as weekends are off. However, if X is reluctant to release me on the 19th, what are my options apart from convincing Y for a later joining date? Is the following option legal? "If I take a leave on the 22nd at X and join Y in the 2nd half, after 6 pm, my relieving date will be the 22nd while my joining date at Y will also be the 22nd." Please advise me on this matter. There is absolutely no problem if relieving and joining dates are the same, provided that you must be relieved before you join. Many organizations do not mention the time of relieving and joining, but most mention along with the date whether the event took place in the FN (Fore Noon) or AN (After Noon).

For example, if your relieving letter states that you were relieved on the 22nd FN and your joining letter states that you joined on the 22nd AN, there seems to be absolutely no problem.

Please check with your current organization's HR policies as most organizations would not permit employees to take leaves during their notice period.

There seems to be a problem with logistics. If he is relieved at 3:00 pm in Delhi, it is not possible to reach Pune by 2:00 pm. Perhaps on the first day, he can join a bit later, say by 6:00 pm or 7:00 pm, with prior permission from his future employers.
