I am working at an automobile company where only 450 workers are enrolled. We also have a work committee, but there are only five members from the workers' side, whereas only three are available from the management end.

Sec. 3 of the Industrial Disputes Act, 1947, provides for the constitution of a Works Committee, which shall consist of representatives of workmen and employers in such a way that the representatives of workmen shall not be fewer than the representatives of the employer. However, you may refer to the order of your State Government issued in this regard, which lays down some guidelines.

Please provide information on the strength of the work committee members among the five hundred workers and management members. How should new members be elected if an existing member leaves the job? Can the same member be part of all committees that exist within the works committee?

You need to see your State Rules, which may differ from state to state, as well as the order of the Government of the State in which your establishment is located. So far as establishments falling under the Central sphere, the number of workmen's representatives shall not exceed 20, and they shall represent the various categories, groups, and classes of workmen engaged in the establishment. Please refer to your State Rules and you may also consult the Labour Commissioner (State) in this regard.
