Employee Refusing Final Documents: How Should I Handle This Situation?

jaya h d
Hi, I have terminated an employee, and now the employee is not accepting her full and final documents, i.e., salary slip, severance pay, and tenure certificate, and not signing the no dues certificate. We are emailing the documents. What should be the matter acknowledging the same.

Dear Jaya,

A brief reply to your brief question would be: She is within her rights to accept or not accept, being an ex-employee.

Warm regards.

Send her the documents and the cheque for the settlement by registered post. It should be adequate.

Some managers wisely terminate an employee, and when a problem arises, as in this case, they rush to CiteHR for a speedy remedy. They should also, as employees, introspect about their fate if a similar situation arises for themselves. Whether or not to accept the No Dues Certificate (NDC) depends on the circumstances. If the company has followed due process or natural justice to terminate service—without disclosing the reason for termination—full and final settlement (F&FS) may be suggested to them by seniors. We hope to hear from the querist about the outcome, including reasons for termination, etc.

Send hard copies of all the documents through Registered post with Acknowledgement due. If he does not receive the same, display it on the company notice board and credit the settlement amount to his bank account.
