Dear Concern,

Please clarify for me the Bonus Calculation as per the Payment of Bonus (Amendment) Act 2015. Please clarify the following cases:

As per the amended act, we need to calculate the bonus on Rs. 7000 or the minimum wages payable for the respective industry. Hence, if the minimum wages payable are greater than Rs. 7000, then the bonus is to be calculated on the minimum wages.

1. If the Basic salary is Rs. 6000/- and the Minimum Wages are Rs. 8554/-, do we have to consider the Minimum Wages (Rs. 8554/-) for Bonus calculation or Rs. 7000/-?

Hi Friends!

My basic salary was Rs. 13,500, and my take-home pay was Rs. 24,470 in my last organization. I left that company on 8th Oct 2015. Am I eligible to receive my bonus for the last financial year or not? I am actually confused. Please let me know.

Dear Neetu,

What is the total period you worked with your last organization?

According to the Payment of Bonus Act, 1965, Section 8, every employee shall be entitled to be paid by their employer in an accounting year bonus in accordance with the provisions of this Act, provided they have worked in the establishment for not less than thirty working days in that year.

You are eligible for a bonus for the years 2014-15 if there are no issues. It is clear.

There are 2 conditions for the calculation of the bonus:

1. 7000
2. Minimum wages

I have two questions pertaining to the calculation of the bonus:

1. If the minimum wages are more than 7000/-
a. Minimum wages to be considered as on which date? 31st March or what?
b. Should the average of every month's minimum wage be considered?

Dear all,

The amendment clearly indicates that you have to pay a minimum bonus of Rs. 7000/- or the minimum wages declared by the government in the scheduled employment, whichever is higher. Therefore, you have to pay a minimum bonus of Rs. 7000/- in any case. If the employee is drawing a salary higher than Rs. 7000/-, then the minimum wages declared by the government will be the maximum limit. Of course, proportionate deductions will be made based on attendance.
