Navigating Maternity Leave During Probation: What Are My Rights and Options?

Hi, I'm a sales officer in a bank. I got pregnant after joining the bank; this will be my 3rd baby. By right, a confirmed staff will be entitled to 3 months of paid maternity leave. However, as I'm still under 6 months probation, I might get an extended probation as I have been achieving sales targets all this while. My concern is, will I be entitled to 3 months or 2 months of paid maternity leave? Or unpaid maternity leave? Thanks.

This is the eligibility for claiming maternity leave.

No woman shall be entitled to maternity benefit unless she has actually worked in an establishment of the employer from whom she claims maternity benefit for a period of not less than eighty days in the twelve months immediately preceding the date of her expected delivery.

Probation period is not mentioned in the Maternity Benefit Act.

You have not mentioned the name of the bank in which you are working. Please also consider reviewing the terms and conditions of your employment, especially if the bank is a PSU or government-controlled bank.

From your previous post, it appears that you are working in Malaysia. Therefore, an important question arises regarding which labor laws are applicable to employees of your organization in Malaysia.

Hi member,

Maternity leave is not linked with probation period extension. Maternity leave is valid; probation period will be extended in case of invalid leaves or absence only. Sanction of maternity leave depends upon the organization's rules.
