Termination of Employment: Seeking Advice
I was working with a private MNC as a workman in Bangalore for close to 7 months. I joined the company in April 2015 and was under probation for 6 months. However, they have not confirmed my probation since I resigned.
During our joining, consent was taken from the employees for a 'Training bond,' but there was no mention of the training bond and its clauses in the offer letter.
In my 6th month of probation, I received an offer from another MNC for a better role and package, based on which I sent a resignation email on 19 OCT 2015 to my manager.
Two weeks after my resignation, HR is asking me to sign the bond forcibly or pay a bond amount of 2.5 lakhs, which was never discussed during our joining. They stated that if I fail to comply, the exit will not be smooth, and they will not provide any service letters or relieving letters, and I would be terminated.
The offer letter mentions a 2-month notice period.
Discussions were ongoing with HR and management regarding the training bond since I had already resigned and was under my notice period. I had already served 1 month and 6 days when I sent a reminder email to my manager to confirm my last working day on 25 NOV 2015. An exit meeting was arranged with the Senior HR and my Manager, where I was pressured to sign the bond. As I had already resigned, I refused to sign, and I was informed that I would be terminated immediately. I was asked to hand over the company belongings and documents, and I was told that a Termination letter would be sent as a hard copy to my mailing address along with the full and final settlement.
It has been over a month, and I have not received any communication regarding my relieving or termination. This delay is affecting my joining with the other company since I do not have confirmation of my relieving.
Can you please advise or suggest the legal action to be taken since this is affecting my career?
