Suspended After False Allegations By Employer

Dear All,

I have been working with an organization for the past 5 years. Recently, I was interrogated regarding financial disputes that I am in no way related to. Now, all of a sudden, I have been suspended from my position, and all my assets have been confiscated, alleging many charges against me. All the allegations imposed are false, and the company does not have proof to support them.

For example, one of the allegations states that I am frequently absent from work, whereas my leave record shows that I have ample leaves remaining, and my comp time is also balanced. This is just one instance; they have also put my salary on hold.

Please advise if there is any provision under Indian labor law to file a case against my employer. This situation has really disturbed me. Can I file a case for mental harassment due to this issue?

First, do not panic or get under tension about what is happening. Be calm and collect evidence and facts in your favor. Now more details will be needed for members to advise. What is your appointment/designation in the firm and how long have you been working with them? What is the financial dispute and your connection to it? What does your suspension order say? Was there any inquiry conducted - if so, on what specific charges? What assets of yours have been confiscated? Consult a lawyer and send them a detailed reply. There are legal remedies to every problem. If one is innocent, it is not easy to be punished in this fashion and get away.

Adding to the above, kindly collect all evidence and try to reach the media so you can get justice without approaching the legal system as it's a time-delay process. You can reach the media very easily as they are waiting for news.

As evident above, there are many gaps of information. It is difficult to suggest anything concrete in the absence of information, as asked by members. However, as things stand, an employer cannot take such extreme steps unilaterally. You may have sufficient grounds to take legal action. Being a lady, the law provides ample safeguards and protection to you. Please take advantage of these, and don't get cowed down or become a victim of Workplace Bullying.

1. Gather all evidence in your favor first.
2. Don't go to the media at this level.
3. Try to sort out in-house only.
4. See the company's legal jurisdiction clause; if it is anywhere or business location jurisdiction, civil court with a good lawyer is required.
