How Can Companies Without Attendance Systems Track 240 Days of Continuous Service for Gratuity?

Hi,

If a company does not have an attendance system, how will the company compute whether an employee has served for 240 days of continuous service? In my company, we don't have an attendance system, and they pay gratuity only to those who have served for 5 years or more, as it is difficult to determine continuous service of 240 days. Please suggest whether continuous service refers to actual working days or when the employee was under the employment agreement.

Thanks,
Bharti

Hi Bharti,

I wonder how an organization does not have an attendance system in place, then how do you pay monthly salary? Every organization should maintain a muster roll, which is mandatory under labor law. If you are HR, then I request you to implement it soon in your organization. The day an employee starts work under the employer will be taken into account for calculating continuous service.
