We are paying one day's salary for the employees working on a weekly off. Is it right or wrong? Let me know if it is correct or not. If it is not, please explain the related aspects.

Hi Buddy,

If an employee works more than 48 hours in a week, then you have to pay double the wages for the excess hour. Therefore, you have to calculate the weekly hours of respective employees and pay them accordingly.

Hello,

As per the Factories Act of 1948, an employee is not allowed to work for more than 9 days. If employees work for more than 48 hours in a week, they are eligible for overtime. Additionally, an employee working on a weekly off should be given compensatory off either prior to or within 3 days of the weekly off.

Regarding the engagement of employees to work on their weekly day of rest, it is important to note that this practice is not in accordance with the provisions of the law. There are two options available in this scenario:

1. Either you must pay the employee double the rate of wages for the day they worked, or
2. You can provide the employee with a compensatory day of rest during the following week in exchange for them working on their scheduled day of rest.

It is imperative that you adhere to one of these options.
