How to Handle a Dispute Over HR and Admin Roles in a Small Company?

Hi, I am working in a small organization for 2 months as an HR. Before my arrival, there was a person handling both the HR and admin departments. When I was selected as an HR, the management decided to split the responsibilities. They designated him as an admin and me as an HR.

Now, he claims that he had already registered himself as the HR and Admin of our company at the labor office, making it impossible for us to change his designation. As a fresher, I lack in-depth knowledge of laws, and the management is also confused. I feel he is deceiving us because he does not want to change his title. After observing his untrustworthy behavior, the management has decided to change his position. Now, we are in a dilemma and seek a solution.

Our organization has 22 employees, and the management, while good, lacks extensive knowledge of HR and labor laws. Please assist me in resolving this situation.

There is no problem if he is considered as an authorized person for signing the documents. There are provisions to change the authorized person's name. Moreover, for small organizations, directors will be the authorized personnel for signing.

Dear Diya, This person is actually deceiving you; there is no such thing as giving a name to any office that prevents changing his designation. As you mentioned in your post, this employee is not trustworthy, and management has decided to change his position. You can directly speak to the head of your company and issue him a demotion letter stating the correct reason, changing his designation from HR Admin to only Admin.

Also, you can ask the seniors to evaluate his or her work performance. If the employee is not performing well, you can definitely issue him a warning letter and later change his designation. Since your company's strength is 22, check with him which labor office he has given his name to and for what reason. It is definitely not true.

It is not about being a fresher but learning to handle the situation tactfully and practically.

As per the Shops Act or the Factory Act, there are two options to update the name and contact details:

1) As an employer (Directors/Proprietors or Partners' names will be given).
2) As a Manager (Any authorized person's name and designation shall be given).

I hope that while registering or amending, he would have given his name as the authorized person. However, the same can still be checked in the certificate issued by the respective department. If there is anything incorrect, it should be changed by amending the certificate.
