Suddenly Asked to Resign: How Can I Legally Challenge My Dismissal?

G K Marthande
Dear friends,

I am working at the engineering college (FIT Pune) as a faculty member for the last four months. I was sacked from my job without any notice or warnings. One day, I was simply called and asked to resign. The joining letter I received from the institute clearly states that one month of notice period or salary of one month will be given before termination of employment.

Please kindly advise me on how to legally fight this situation?

Dear Friend,

Kindly provide details:
1) Have you resigned?
2) Have you mentioned in your resignation that you will serve the notice period from this date to that date?
3) Is it due to any disciplinary action initiated against you?
4) Have they given you any resignation acceptance letter?

Thank you.

Thanks for your reply.

No, I was called on 30th October 2015 and asked for resignation, saying this will be my last working day, and I am yet to give resignation.

No disciplinary action has been initiated against me.
