Understanding Delhi's Minimum Wage: How Should We Structure Skilled Employee Salaries?

vikaskhatter29@gmail.com
Dear all,

As we know, the Delhi minimum wages have been revised w.e.f. 01/10/2015 as follows:
- Unskilled: 9178
- Semi-skilled: 10140
- Skilled: 11154

Now, the question arises: is the basic wage equal to the minimum wages? If we hire an employee in the skilled category (Supervisor) with a gross salary of 12000/- per month, I would like to understand the compensation breakdown. Can we structure his 12000/- wage as (basic 9178, conveyance 800, HRA 2022), or should it be (basic 11154 and the remainder in other allowances)?

Compensation Breakdown for Skilled Employees

Note: Previously, we had been showing the basic as 9100 for all workmen categories (unskilled, semi-skilled, and skilled). For instance, if an employee works as a computer operator with 1+ year of experience and a graduate degree, and is paid 12500/- per month, thereby considered at a skilled level, what would be his compensation breakdown? In the September salary, we showed basic 9100, conveyance 800, and HRA 2600. Is this correct? Kindly advise on the appropriate approach.

Thank you.

Can basic be less than minimum wages... if we have a computer operator whose salary is 12500/- per month gross and he comes under the skilled category. The skilled level minimum wage is 11154/-, so in this regard, what will be his basic – whether it will be 11154/- or 50% of 12500/-? Kindly let me know.

Can basic be less than minimum wages? If an employee is in the skilled category working with a monthly emolument of 12500/-, and as per Delhi's minimum wage for skilled level is 11154/-, my question in this regard is: Is it possible to keep the basic pay less than the skilled level minimum wage, i.e., 11154/-?

The minimum wages have a breakup of Basic and other Allowances. The Basic cannot be lesser than the minimum wage basic.

Dear Friend,

I believe this employee should be classified as semi-skilled, with a basic salary of $10,140. In addition, a conveyance allowance of $1,600 should be provided, with the remaining amount to be allocated as balance funds.

Thank you.
