Understanding Minimum Wage Revision and Forced Labor Implications in July 2015

The Haryana government has revised the minimum wages with effect from July 2015.

Implementation of Minimum Wages

In one meeting on the implementation of MW (Minimum Wages), it was decided that the Revised Minimum Rate for the unskilled category must be increased. Additionally, the contractor laborers who were paid slightly higher before the revision, as they fall into the semi-skilled or skilled category, may receive the revised rate subject to passing a competency/caliber test.

Article 23 of the Indian Constitution

In this context, I would like to refer to Article 23 of the Indian Constitution, which addresses forced labor. Forced labor can manifest in various forms. It could involve physical force compelling an individual to provide services to another for remuneration lower than the MW. Such a scenario categorically falls under the definition of forced labor as per Article 23. The person affected has the right to seek recourse through the courts to enforce their Fundamental Right (Right against exploitation) under Article 23. They can request the court to mandate the payment of the MW to liberate the services provided from forced labor, thereby addressing the breach of Article 23.
