Facing Termination and a Demand for Payment: Should I Pay or Fight Back?

I was terminated by the company because I took a 15-day leave without informing them, due to personal issues. Now, they are asking me to pay the sum of 26,500/- as a due clearance to the company. What should I do? Should I pay them or not? If not, they have threatened to take legal action through the court. Please suggest what I should do.

Understanding Unauthorized Absence

Taking leave without information means nothing other than unauthorized absence, which I think is the cause of action for your termination. Was your termination a result of any disciplinary proceedings against you? Furthermore, there is no mention of why the company should insist on a particular sum from a terminated employee, especially with a threat of legal action in case of non-compliance.

It would be beneficial if you could address the above questions.

With regards to your statement "...they are asking me to pay the sum of 26,500/- as a lieu clearance to the company," this is how I interpret what you are trying to convey. Generally, any termination will clearly mention the reasons, which you seem to have objected to or requested not to be mentioned, resulting in the company asking for the money.

Please confirm if this interpretation is accurate. If not, kindly provide the exact details for the members to offer actionable suggestions. However, as a general rule, no company can ask for money, especially from an employee who has been terminated. Your case appears to be different, seemingly more of a 'deal' gone sour.
