Hi, I am Sandhya Singh working with a private firm and about to complete my 5 years. I am worried about whether I will be eligible for Gratuity or not because I do not have any PF deductions. Please confirm if a person is eligible for gratuity even if there are no PF deductions.

Whether you are covered under PF or ESIC or not, you will be eligible if you have worked for 4 years plus 240 calendar days in a company without any break in service.

Every company with an employee strength of more than 10 will be covered under the Payment of Gratuity Act 1972.

Hi, Ms. Sandhya,

As Mr. Divakar advised, even if the organization is not enrolled with ESI and PF, you need not worry. If the total employee strength is above 10, then you are eligible for Gratuity. Gratuity shall be paid only at the time of quitting the company.
