Madras High Court Stays ESI Notification for Construction: What Does This Mean for You?

Dear All,

Vide order bearing No. 1471732 dated 21.09.2015 in the matter of Builders Association of India, Madurai Centre v. ESIC in WP(MD) No. 16996 of 2015 and MP(MD) No. 2 of 2015, the Madurai bench of Madras High Court has granted a stay in the operation of the impugned notification by ESIC No. P-12/11/11/60/2010 Rev. II dated 31.07.2015.

The said stay order will be uploaded in due course.

Dear All,

Please find attached the copy of the order. This order is not a stay order. The Honorable High Court ordered status quo to be maintained. Stay order and status quo, according to me, are different terminologies in law. The validity of the attached order will be until the next date of hearing. Also, another point to note is that the order of the Honorable High Court at Madras will have a binding effect only within its jurisdiction.

Dear Korgaonkar Ji,

Any update on the above case? I could only see the last hearing date - 16th November 2015 in the Madras High Court (Madurai Bench) case status site.
