Resolving Unpaid Salary Dispute: Managerial Classification and Legal Remedies

Last year, I was working with a South Delhi-based company, and they have not paid my salary for 3 months. As a result, I filed a case at the labor office. It has been 9 months now, and my case is still unresolved at the labor inspector's end. The objection from my previous company is that I cannot be classified under the workman category since my appointment letter states the designation of Manager. Consequently, the case has been transferred to the labor commissioner's desk.

Can anyone suggest what further action can be taken in this matter?

If it were true that you were employed mainly in a managerial capacity, you are not entitled to any remedy under labor laws for the non-payment of your salary. Therefore, you have to file a suit before a civil court for the amount due together with damages.

What was the nature of your job? Designating you as a manager does not automatically make you a manager. How many workers did you supervise? Can you provide more details about your job, such as the number of people under your control or supervision?
