Model Standing Orders: Do They Really Need Certification from an Authority?

parimal564
Dear Sir,

I work for an engineering company with fewer than 100 employees. My question is, should a model standing order be certified through a Certifying Authority or not?

Kindly provide a Word/PDF file of the Model Standing Order.

Best regards,
Parimal

Model standing orders are not required to be certified by authorities. Once the employee strength exceeds 100, you are required to create standing orders specifically for your company and get them certified with the labor department. You can buy a book from legal book sellers and follow it, or you can download it from the internet.

Also, I want to know if the company has its certified standing orders from the last 20 years. How can it be amended? Where will I get the proof of the certification?

The applicability of the Standing Orders Act is not based on the number of employees but on the number of "workmen" as defined under the Industrial Disputes Act. At the national level, it is 100 or more workmen, but some states have reduced it to 50 or more workmen. You should check your state's amendments.

The very basic information lacking in your question is how many of the employees are non-executives and in which state your company operates.
