Facing EPF Withdrawal and Unpaid Notice Pay Issues: What Legal Steps Can I Take?

Dear All, I have been working at a company for the last three and a half years, but the company terminated my employment with immediate effect without paying my notice pay. They informed me that the company currently does not have sufficient funds, and they will pay my notice pay at a later time. However, they have not made any payments so far.

EPF Withdrawal Issue

Now, I am trying to withdraw my EPF, but the company has not provided me with Form-19 with the required signature. They told me to first settle my postpaid mobile connection bill. The company transferred my personal mobile number to a corporate post account for company use after I left the job. Although my number remained active for two months, it was eventually disconnected due to an unpaid bill. The company insists that I settle the bill before they provide me with the EPF form.

EPF Share Deposit Issue

Additionally, the company has not deposited my EPF share since February 2015, even though I left the company in May 2015. I am seeking advice on what legal actions I can take against the company.

Non-deposit of EPF deductions is an offense, and if you complain to PF authorities, action will be taken against them.

Presently, are you working? If you're working, you can transfer the previous PF amount to the current PF account.
