Revoking Resignation If Not Relieved On Requested Time Period

HI ,
Employee Resigned, Lets Say he has 60 Days of notice Period discussed with HR Manager & negotiated to 40 days HR manager approves it verbally & later if he did not relieve the employee in 40 days. Does the employee has right to revoke his resignation ???

An employee has the right to revoke his resignation anytime before it is approved/accepted and financial benefits disbursed..
What does your standing orders say about resignation and acceptance.

Thank you very much ! the Link is very useful. So am employee an revoke his resignation before it comes to an end . for eg: if he has 60 days of NP he can revoke that in 45 th , 47th day till 59th Day ??? even if it is accepted by Employer

Basically point to be kept in mind is whether employer-employee relationship subsists.
During notice period the relationship subsists.
It is open for an employee to withdraw resignation before it is actually accepted by employer.

The employee can withdraw his resignation. That is true. However, the question that comes up them is that has the employee accepted that ?
The withdrawal has no validity if the employer does not want the employee on his roles any more.

But if an employee has good Performance Records, Disciplinary Records how an employer can ask an employee to put down his paper by forcing him

What you say can have merit in theory but in real life if management wants a person out,no law can really help him.
He can go to courts and fight endless battles but justice will be delayed and at times too late to be effective.
That is the sad reality of life.

The 2 posts you have made do not seem to reconcile.
First you said someone resigned but since he was not relieved early wants to revoke his resignation. Then you are talking if someone who was forced to resign.
Which of the above is the actual scenario ?
