Dear Friends,

If an employee resigns from a company without notice in a single day and without a handover, does the company still owe full and final settlement to him?

Also, if a company terminates an employee on disciplinary grounds or for misbehavior with a director, does the company still owe full and final settlement to him?

Please advise.

The company should conduct a Full and Final settlement after deducting all dues, including the value of items not surrendered to the company. Whether a company terminates based on discipline, financial dues should not be withheld. Termination is the consequence of indiscipline.

Dear All,

Our employee resigns without notice period. His full and final payment is held up for a few days only because his/her dues and other deductions will be deducted from the full and final payment only.

The F&F cannot be kept open. We need to calculate the notice period, adjust the leaves, take into consideration the advance to the employee and the company properties provided to him, make the necessary deductions, and then pay the F&F. This can also be done with the normal salary cycle.

In the case of termination, also the F&F has to be paid considering all the above points.

Apart from what Mr. Asutosh Thakre has mentioned, the salary has to be paid within 7 days from the last working day, and the FNF has to be paid within 30 days of the last working day.
