Please tell me, one of my friends has been terminated from the company due to the submission of a fake service certificate. However, the company is now refusing to pay him any amount, including his salary, F&F, and the money deducted for leave encashment. Could you suggest the best legal action that can be taken against the company and outline the procedure for it? My friend claims his actions were due to the misinformation provided by the HR personnel of the company. He is in a very difficult financial situation and feels deceived by the company. Can he pursue legal action under company law by hiring a lawyer?

Your friend has put himself in a corner by submitting a fake experience certificate. He can be in serious trouble for this. Handle the situation with care. The maxims "ex turpi causa non oritur actio" and "he who comes to equity must come with clean hands" should be borne in mind by the friend of the poster. The company will likely discover the fake experience certificate, and the whole matter will take a different turn. Ask your friend to gently and politely try to get his dues released. A legal approach will not be helpful in this case.
