Facing Termination Over False Reporting: Will I Still Get Gratuity and Leave Encashment?

Dear Sirs/Madams,

I am working as a Training Manager in a pharmaceutical company in the field. No one reports to me. I've been with this company for the last 20 years.

Now, the management is alleging FALSE reporting by me and threatening to terminate my employment. I want to know if I'm terminated, will I be entitled to Gratuity and Leave encashment or not?

What is the nature of false reporting alleged? Have they alleged that the company has suffered a loss in business due to false reporting? If you are a trainer, how has your training activity or lack of activity affected the company? For advice from qualified members of the forum, more specific details are needed.

As Nathrao has rightly said, you have to be more specific. As per your submission, they have threatened to terminate you. Have they issued any show cause, or asked for an explanation, or is any inquiry being conducted? Generally, false reporting by you should not cause any damage to the company, as per my assumption. Hence, gratuity and encashment cannot be declined.

In case of termination, you should be entitled to all monetary benefits related to your full and final settlement as per the norms according to the labor law of the country.

In our field, "false reporting" means not meeting a customer, i.e., a doctor, and reporting to the company in our daily report that you have met him/her. On first hand, there are no direct financial damages to the company by this act, but this act of "False Reporting" is considered to be one of the biggest crimes in the pharma industry.

Do not panic. No one can stop you from availing the benefits of leave encashment and gratuity. As you mentioned that you do not have a supervisory role, you are covered under the Industrial Dispute Act. Terminating you is a lengthy process.

It is advisable to talk to your seniors and resolve the issue at the table.
