Understanding Maternity and Miscarriage Leave Entitlements: Clarification on Employee Leave Policies

Hi,

We are entitled to 37 days of leave per year, which includes Earned Leave (EL), Casual Leave (CL), and Sick Leave (SL). Female employees are entitled to a maximum of 12 weeks of paid maternity leave. In the case of a miscarriage, she can avail of 6 weeks of paid leave.

My question is, are these leaves in addition to the 37 days of leave already provided to each employee, or are they part of the 37 days?

Dear Aavni T,

As per the Maternity Act of 1961, these 12 weeks do not include EL, CL, or SL. Female employees are entitled to 12 weeks of paid maternity leave.

Any leave as per the MB Act cannot be included with regular leaves; it is altogether different from other leaves available in her credit.
