Am I Officially Registered as a Welfare Officer in U.P.? Seeking Clarity and Guidance

Dear All,

Please tell me about the registered welfare officer in U.P. I am working as a welfare officer (Grade-III) in an auto ancillary division from March '13 to the present. The company provided me with an appointment letter at the time of joining, but no further letters have been issued to me since. Therefore, I would like to confirm whether I am a registered welfare officer or not.

Can you please share with me a format for an appointment letter for the position of Labour Welfare Officer? Also, what is the current compensation that should be provided to the Welfare Officer as per the act?

I am not able to understand your query regarding the registration as a welfare officer. There is no system of registration. Though there is a statutory requirement for the appointment of Welfare Officers under Section 49 of the Factories Act, 1948, which states that "in every factory wherein 500 or more workers are ordinarily employed, the occupier shall employ in the factory such number of Welfare Officers as may be prescribed."

The Uttar Pradesh Factories Welfare Officers' Rules, 1955, have prescribed everything starting from advertisement for the recruitment to termination, including qualifications, duties/functions, disciplinary action, and terminal benefits. You may refer to the Uttar Pradesh Factories Welfare Officers' Rules, 1955, which will prove to be handy for you for any queries relating to your appointment as a Welfare Officer.

As per the Mines Act, approval has to be obtained for the appointment of a 'Welfare Officer' from the Director General of Mines Safety.

Dear Nataraajhan,

You are correct in mentioning the requirement under the Mines Act. Similarly, under the Factories Act of 1948, the Welfare Officer has to send a monthly report to the Chief Inspector of Factories. You have to seek permission from him for the termination of the Welfare Officer's services.
