Confused About Resigning from Court Clerk Job for Bank Offer: Notice Period and Lien Questions

I am working in a court in Gujarat as a clerk and am a permanent employee. I have received a job offer from Indian Overseas Bank as a clerk. When I applied and received an interview call from the bank, I informed my department and obtained a No Objection Certificate (NOC) for the interview purpose. Now that I have been selected by the bank and wish to join, I am unsure about the notice period requirements. Do I need to pay the notice period fee, or can I resign immediately without paying it due to the NOC? Additionally, is it possible to keep a lien for changing the job for 6 months or 1 year?

Please help me out as I am very confused.

You can't have your cake and eat it too. The moment you quit job number 1, that option is closed. So, think about all angles, aspects, discuss with well-wishers, friends, in court, or at the bank, and then decide.

As far as I know, a government employee can join another position while retaining their lien over their previous post for one year, i.e., while obtaining Leave without Pay. All information must be provided to the employer when obtaining such leave. However, when it comes to serving the notice period, the same requirement remains, and you must either serve it or buy it out.

Therefore, please confirm with your department before making any decisions.

You need not follow the due procedure for resigning. Please verify your appointment letter. Since this cannot be a technical resignation, you cannot keep the LIEN.

Resignation and Lien Process for Gujarat Judicial Ministerial Service

I believe you are part of the Gujarat Judicial Ministerial Service. As you have already secured a No Objection Certificate (NOC) for the banking job, all you need to do is resign from your current position by stating the reason. Your resignation should be submitted to the Appointing Authority, either the District Judge or the Registrar of the High Court, as applicable, through the proper channel. You must wait for the acceptance of your resignation and the issuance of relieving orders.

Understanding Lien in Job Transfers

The question of lien will only arise in the case of inter-departmental or inter-governmental transfers of services. In such situations, you cannot resign but can only request a transfer. Since the Banking Sector is considered quasi-Government Service, it is unlikely that you can request lien after resigning.
