Understanding India's Minimum Wages: How Are They Set and What Should Employers Know?

imneerajkumar
What are the minimum wages? How do we define minimum wages for different states? Is there any guideline that talks about the standard Minimum Wages Act in India?

In India, minimum wages are set by the government for different categories of workers and vary from state to state. The Minimum Wages Act, 1948, provides a framework for determining minimum wages based on factors such as the type of employment, skill level, and cost of living in a particular region. Each state has its own schedule of employments and minimum wage rates that are periodically revised to ensure fair compensation for workers. It is essential for employers to comply with these regulations to avoid legal consequences and ensure the well-being of their employees.

Understanding Minimum Wages

Minimum wages refer to the lowest wages that should be paid to employees, without which a company has no right to exist or do business. These wages are regulated through the Minimum Wages Act. The state governments have been given the power to notify minimum wages applicable to different industries in their respective states. Accordingly, different states have notified different scheduled employments and have fixed minimum wages applicable to different categories of employees in these scheduled employments. The number of scheduled employments may vary from state to state. Similarly, the minimum wages applicable to the same industry in different states may also vary. Therefore, you have to refer to the state notification of minimum wages with reference to the industry concerned to know exactly what the bare minimum wages are that you should pay to different categories of employees.

Minimum wages are not just applicable to workers; the notification is expected to specify the wages to be paid to supervisors and even managers. Since these are the minimum wages, there is nothing illegal in paying higher wages to any employee. Also, if any employee is receiving a higher wage than what is notified by the government, they are expected to get protection of the existing higher salary.
