Unpaid Wages: How Long to Keep Records and What to Do If You're Not Paid?

lokeshsharma9
Hi,

Please tell me about the salary and wages. If unpaid, what should we do? How many years do I have to keep the records? After that, where should I remit them after the expiration of the years?

Regards

You can keep the unpaid wages/fines for 3 years. Then, you should deposit them in the labor welfare fund if they are not claimed by the person.

Dear Mr. Stephen,

Thank you for sharing such an important point. Could you please share any notification or section regarding depositing the unpaid wages into the Labour Welfare Fund.

Thank you.

Understanding Unpaid Accumulations Under the TN Labour Welfare Fund Act, 1972

As per the TN Labour Welfare Fund Act, 1972, Section 2(i) defines "unpaid accumulations" as follows: "Unpaid accumulations" means all payments due to the employees but not made to them within a period of three years from the date on which the payment became due, whether before or after the commencement of this Act. This includes wages, bonuses, and gratuity legally payable, but does not include the amount of contribution, if any, paid by an employer to the provident fund established under the Employees Provident Fund Act, 1952.

Check your state's act. Mostly, the same provisions would be applicable.
