I need urgent advice.
Case History
I was working with one of the startup companies. I joined the company on 11th August 2014 as an area sales manager. On 13th April 2015, my business head informed me that the company is winding down sales operations. He verbally informed me that the company would pay salespeople a 1-month salary, i.e., from 13th April to 13th May, and we would be considered resigned employees. However, I got an opportunity in another company, so I requested to accept my resignation until 30th April 2015.
Case Problem
On my last day of handover, HR told me that I would receive my FNF (Full and Final settlement) and relieving letter after 45 days. So, I waited patiently for 45 days. I emailed HR on 22nd June for my FNF and relieving letter but received no response for 2 days. So, I went to the office in person and met HR there. She informed me that I would receive my FNF in July, as informed by the director. Luckily, I received my relieving letter on that day.
The next day, I sent another email to request the release of my FNF. After 3 days, on 29th June, all salespeople received an email from HR to submit reports of client details, as a new business head had been appointed. The email stated that the FNF would only be released if the new business head was satisfied with our reports. I called the new business head for a report discussion and requested him to release my FNF first, as I had lost trust in the company's policies. However, he did not agree to this condition and mentioned that he would get back to me by 10th July. As expected, he did not call me back.
Therefore, I sent a legal notice to the company to clear my dues within 7 days. They left the notice unclaimed. I need strong advice on the next course of action. If I have to file a case, which sections will be applicable?
