Does a School with 15 Staff Qualify for ESIC? Seeking Government Order Details

Can I have the details regarding whether a school with 15 staff (Teaching and Non-teaching) falls under ESIC? If so, please provide the relevant Government Order (G.O) or Notification.

1. Sir, with effect from 01/04/2011, educational institutions (including public, private, aided, or partially aided) run by an individual, trust, society, or other organization, situated in NCT, Delhi, and employing 10 or more persons are covered under the ESI Act, 1948.

2. You can obtain instructions on ESI, including a copy of the notification, from the appropriate regional/sub-regional office of ESIC to which your establishment is attached.

CHENNAI: The Madras High Court on Tuesday stayed the Tamil Nadu government's proposal to make unaided private educational institutions in the state subscribe to the Employees' State Insurance (ESI) scheme for their teaching and non-teaching faculty members.

Referring to a Supreme Court order in favor of similarly placed schools, the first bench of Chief Justice Sanjay Kishan Kaul and Justice T S Sivagnanam disposed of the cases filed by about 370 schools in two batches against the government's proposal. The matter relates to a notification issued by the Labor and Employment Department on June 4, 2008, proposing to extend the provisions of the ESI Act, 1948, to educational institutions, but excluding government and aided institutions.

Though, as per norms, this preliminary notification should have been followed by a final notification after following procedures, the government did not do anything for the next two-and-a-half years. It then issued an order in December 2010 to extend the ESI Act provisions to unaided private schools, though the preliminary notification itself lapsed at the end of six months.
