Can My Employer Legally Withhold My Salary After Termination for Fraudulent Experience?

Hi, I joined a new BPO company in May 2015 called Admiral Solutions (EUI Ltd), located in Delhi. Due to pressure from a consultant, I had to show fraudulent experience. During the Background Verification, I got caught on 28 July 2015 and was terminated on the spot. The company says they will not do a Full & Final Settlement nor will they pay my salary. Other companies in the industry do pay the salary even if they terminate the employee on grounds of misrepresenting the facts, like Aon Hewitt, Amex, etc.

Legal Concerns Regarding Salary Withholding

Is this legal? Can a company withhold my salary? Can the company file a fraud case against me?

"Due to pressure from the consultant, I had to show fraudulent experience." Cardinal error. There is no point in trying to now blame the consultant for this intentional mistake. You can request your company to overlook this mistake on the grounds that your consultant advised you to do so and that you do not have sufficient experience in work-related matters and were not fully aware of the consequences. Verbal requests to release your payments can be made. The company can take legal action against you if they really desire, but I do not think they will waste their time and money pursuing a case against you. However, you will have to compromise with the company and find a mutual solution. Lesson to be learned - Never fudge experience or documents, etc. They make your position weak.
