Understanding ESIC Deductions: Should Ex-Gratia Payments Be Included Quarterly, Half-Yearly, or Annually?

Hi,

Can anyone tell me if we pay ex-gratia quarterly, half-yearly, or annually, should we deduct ESIC over it?

Dear friend,

If the payment of ex-gratia is in lieu of a bonus, it is not part of the salary. Accordingly, ESI need not be deducted.

ESI contribution is not payable on any additional payment/remuneration paid at an interval exceeding two months. Ex-gratia is an additional payment. There is no legal requirement or obligation on you to pay it, and you are paying it at an interval of more than two months, i.e., quarterly basis, half-yearly basis, or annually. Therefore, no ESI contribution is payable by you.
