How Can I Resolve Salary Discrepancies in My Contract-to-Hire Job? Seeking Advice!

Dear Team, I need all your help and great suggestions. First, I would like to explain my problem. I have joined ABC Company (payroll) to support XYZ Company (Client) as a contract employee (C2H). As per the date mentioned in the offer letter, I joined. However, now ABC Company is saying that they will only give the salary from the onboarding date to XYZ Company. They are also saying they will not pay for the days before onboarding (20 Days). But as per the offer letter, I reported to ABC Company, and there is no fault or delay from my side.

They also mentioned another reason: my last company gave a late reply for the BG mail. I asked them why they didn't inform me when they weren't getting a prompt reply. When I checked with the HR of my last company, they said they had not received any BG mail from ABC Company. Again, I provided my HR's email and mobile number to ABC Company.

This is the first time I have seen a situation where they hold the candidate for BG. BG is not my responsibility, yet they are not paying me. I tried to contact my concerned person, but he’s not giving me an appointment; he always says he is busy or outside.

Note: XYZ is a level-5 MNC Company. Without any projects, they recruited us, and we are feeling very disappointed.

Seeking Suggestions

Kindly suggest how to get the salary as per the offer letter. What steps should I take now? If I take any steps, is there any chance they might remove me from the job?

You actually have two choices. Accept that you will not get the next 20 days' salary or leave and find another job. You have tried to explain the matter, and they are not willing to listen.

You can, of course, complain to the labor officer of your area, but you will simply lose your job, and it may not help in any case. Plus, it may be a roadblock to your future career if prospective employers know you filed a complaint before.

Job Security Concerns and Salary Discrepancies

With what reason will they remove my job? What is my fault? Is it my fault to join as per the offer letter? What is the delay from my side? Did I delay in providing any document? No, right? How can they say they will remove me? May I know the reason? Simply, ABC Company is saying that XYZ Company has not provided to us, that's why we will not provide to you. How is it correct? I don't know. ABC Company needs to demand from XYZ Company, and I need to demand from ABC Company. Right? If you have any extra information, please provide me. That's it.

There is no shortage of reasons to remove you:

1. In probation termination without notice.
2. Unsatisfactory work (IT is not covered in Industrial Dispute Act).
3. Negative response from BGC.
4. Client didn't like your behavior.

Off the top of my head, this is the list. You can't do anything about it, so don't annoy the company. Twenty days' salary will hardly matter in the long term if you work properly. In the end, you will earn much more than you lose.

Your ask is valid! I am unsure of the process of the MNC company hiring contract employees for the bench. They should have had a plan for deploying. Please check with your payroll if they have signed any PO in your case from the date of joining.

Also, request some compensation, which can be provided from their end. Do confirm your work during those 20 days was with which company. Most BGV processes are done for contractor employees only after joining as their joining date is minimal.

I would tend to agree with Saswata Banerjee's suggestions. There are many fly-by-night companies in the IT sector that leave crucial aspects of the terms vague. This was the scenario in the USA until a few years back—of not paying salary while the employee was on the bench, i.e., not assigned to any project/client—but now things have become far better. However, this wasn't an issue in India. I can see that this ABC Company is playing around. The best option for you would be to look for another job ASAP, especially since you say 'XYZ is a level-5 MNC Company without any projects.' Even if you resolve the issue here, being in the IT sector, you would tend to lose touch with your technical skills if the gap is high.

CMM Levels and Their Current Value

CMM levels are so common today that the certification has lost much of its charm and value. There were days when even CMM Level 2 or 3 was looked upon very highly. I know of companies that are Level 5, but the practices inside don't even make them deserve even Level-1. So, I suggest not to go by these levels, etc., in your next job search. Do some due diligence about the company before you join.

Dear Team,

My name is Mahendar Karra. Actually, I have been selected for ALCHEMY SOFTWARE SOLUTIONS, which is my payroll company, and the client is IBM. After two months, they said they don't have projects, so they are re-deploying me along with around 500 other employees who joined like me. Now my consultancy is saying that they also won't provide any salary. At least they should provide one month's notice period as per the offer letter. From my joining date onwards, they have really been playing games with me, as they have not even provided a full month's salary.

Seeking Legal Advice

Can I go through the consumer court? Kindly suggest ways on how to take action against the company. My worst experience with IBM is that without informing me, they removed my access at the gate entry. IBM is one of the worst big companies.
